General terms and conditions of sale

Clause 1: Purpose and Scope

The general terms and conditions of sale described below detail the rights and obligations of the 3dBZH micro-enterprise and its customer in the context of the sale of 3D printing services.

Acceptance of the quotation/order form, including the clause "I acknowledge that I have read and accept the attached general terms and conditions of sale", implies the buyer's unreserved acceptance of these general terms and conditions of sale.

Clause n° 2 : Limitation of use

3dBZH reserves the right to refuse to print any item that is manifestly illegal, contravenes public decency, or may contribute to the creation of a weapon.

The customer is responsible for the design and quality of the object supplied to 3dBZH for printing. 3dBZH's role is limited to 3d printing and does not include designing or correcting 3D objects.

As with any manufacturing process, FDM 3D printing involves its own artifacts: visible layers, Z-joints, etc. 3dBZH cannot be held responsible for these.

Objects printed by 3dBZH must never be used in critical applications: aerospace, medical ...

Items printed by 3dBZH must not be used by children.

Clause n° 3 : Price

The prices of the goods sold are those in force on the day the order is taken. They are denominated in euros and calculated exclusive of tax. Consequently, they will be increased by the VAT rate applicable on the day of the order.

3dBZH reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

A minimum order of €15 and a maximum order of €2,000 apply.

Clause n° 4 : No cancellation

Since orders are made to order, it is not possible to cancel them once production has begun.

If a cancellation is made prior to the start of production, it will be accepted and no charge will be made to the customer.

Clause 5: Terms of payment

Payment for orders can be made by credit card or bank transfer, exclusively in euros.
Credit card
Payment can be made by credit card (Carte Bleue, Master Card or Visa), using the secure Stripe platform.
Bank transfer
Bank charges are at your expense, and the funds transferred must correspond exactly to the amount to be paid. The transfer must reference the invoice number.

Clause n° 6 : Late payment

In the event of total or partial non-payment of the goods delivered on the due date, the purchaser must pay to the company 3dBZH a late payment penalty equal to three times the legal interest rate.

The legal interest rate is the one in force on the day of delivery of the goods.

This penalty is calculated on the amount including VAT of the sum still due, and runs from the due date of the price without any prior notice of default being necessary.

In addition to the late payment penalties, any sum, including the deposit, not paid on the due date will automatically give rise to the payment of a fixed penalty of 40 euros due for collection costs.

See articles 441-10 and D. 441-5 of the Commercial Code.

In case of late payment, 3dBZH reserves the right to suspend production or delivery of goods.

Clause 7: Delivery

The delivery is made free of charge.
The delivery time indicated at the time of the registration of the order is given only as an indication and is not guaranteed.
Consequently, any reasonable delay in the delivery of the products will not give rise to:
- the allocation of damages;
- the cancellation of the order.
The transport risk is borne entirely by the buyer.
In the event of missing or damaged goods during transport, the buyer must formulate all necessary reservations on the order form upon receipt of the said goods. These reserves must be, moreover, confirmed in writing within five days after delivery, by registered mail addressed to 3dBZH.

Clause 8: Force majeure

The responsibility of the company 3dBZH (corporate name) can not be implemented if the non-performance or delay in the performance of one of its obligations described in these general conditions of sale arises from a case of force majeure. In this respect, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.

Clause 9: Liability

3dBZH shall in no event be liable for any consequential damages (such as loss of revenue, loss of profits, loss of opportunity, damage to reputation, etc.) that may result from, or in any way be related to, the contract between 3dBZH and the customer, or arising from defective products, or from the performance of these general conditions of sale.

Clause 10: Dispute Resolution

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.
In case of dispute, the customer will first contact the company 3dBZH to try to obtain an amicable settlement.
In the absence of amicable resolution, the dispute will be brought before the Commercial Court of Brest.
